Under the 2021 Rules of Procedure of the NPC, the following may file a complaint:
File a filled-out and notarized complaint assisted form or a verified complaint together with copies of any evidence and witnesses’ affidavit through the following:
Electronic documents must be digitally signed and in .PDF format (if practicable), on page sizes compliant with A.M. No. 11-9-4-SC known as the "Efficient Use of Paper Rule" issued by the Supreme Court of the Philippines. If submitted in this digital format, the NPC may charge fees for printing.
If submitting through a portable electronic data storage device (ex. CD’s, Thumb Drives, etc.), similar portable data storage devices containing the same files must also be given to any opposing party so named. One portable data storage device is equivalent to one copy. If the portable data storage device is infected with malware, the documents will not be considered as having been filed.
From the time complaints are received, the Complaints and Investigation Division, through its Investigating Officers, has thirty (30) calendar days to give due course or dismiss the complaint without prejudice.
From here, the entire process, up to final adjudication, should take about ten to twelve months.
If there is an application for the issuance of a temporary ban on the processing of personal data, the complaint proceedings will be suspended until the application is finally resolved. A summary hearing or submission of position papers or other pleadings and the payment of the proper bond17 is necessary. This process can happen from one to two weeks after the filing of this request.
If the subject of the complaint is a data breach that the personal information controller must report to the NPC, the NPC may already be acting on the matter before you even file the complaint.
Ayon sa 2021 Rules of Procedure ng NPC, maaaring magsampa ng reklamo ang mga sumusunod:

Ang mga elektronikong dokumento ay dapat na digital na nilagdaan at nasa .PDF na format (kung magagawa), at ang mga pahina ay sumusunod sa Efficient Use of Paper Rule. Kung isinumite sa digital format, maaaring maningil ang NPC ng bayad para sa pag print ng mga ito.
Kung nagsumite sa pamamagitan ng portable na electronic data storage device (halimbawa CD, Thumb Drives, at iba pa), ang mga katulad na portable data storage device na naglalaman ng mga file ay dapat ding ibigay sa kabilang partido na pinangalanan sa reklamo. Ang isang portable data storage device ay katumbas ng isang kopya. Kung ang portable data storage device ay nahawaan ng malware, ang mga dokumento ay hindi ituturing na nai-file.
Mula sa pagtanggap ng mga reklamo, ang Complaints and Investigation Division, sa pamamagitan ng mga Investigating Officers nito, ay may tatlumpung (30) araw upang bigyan ng karampatang aksyon o i-dismiss ang reklamo.
Mula dito, ang buong proseso, hanggang sa huling paghatol, ay maaaring tumagal nang humigit-kumulang sampu hanggang labindalawang buwan.
Kung mayroong application for the issuance of a temporary ban on the processing of personal data, ang mga paglilitis sa reklamo ay masususpindi hanggang sa tuluyang malutas ang aplikasyon. Kinakailangang may magaganap na summary hearing o pagsusumite ng mga position paper o iba pang mga pleading at ang pagbabayad ng tamang bond. Maaaring mangyari ang prosesong ito mula isa hanggang dalawang linggo pagkatapos ng paghahain ng application for the issuance of a temporary ban on the processing of personal data.
Kung ang inirereklamo ay isang data breach na dapat iulat ng personal information controller sa NPC, posibleng naaksyunan na ng NPC bago pa man may naghain ng reklamo.
